The Governor’s office is in serious consideration of a new Workers’Compensation policy regarding COVID-19. The new policy would presume thatany “essential” employee that contracts COVID-19 to have an occupationaldisease, and that it arose out of and in the course of employment. As you mightexpect, the construction industry does not support such a broad use of theWorkers’ Compensation system. “Essential” workers can come from any numberof fields. For many of those workers, the nature of their jobs doesn’t allow them tofollow the same enhanced safety procedures that we are able to provide ourworkforce on job sites. A policy of this magnitude would unnecessarily add greaterburden to an industry that is already facing extraordinary costs in keeping incompliance with current COVID-19 orders.
