As a reminder to the ECA Member Message first sent out on September 21, AB685, a law that mandates imminent notification to employees, and timely notification to local and state public health officials of COVID-19 cases at workplaces goes into effect on January 1, 2021. It requires employers to notify all employees within one business day that they have been potentially exposed to COVID-19 if any person at the worksite happens to test positive, has been ordered to isolate, or has passed away. The law also strengthens Cal/OSHA enforcement authority through Orders Prohibiting Use (OPU).

The second link is a sample template letter that signatory employers may use to satisfy union requirements for employees covered by a Collective Bargaining Agreement as the employee’s exclusive representative.
