Dear Members,

Related to previous ECA member messages regarding the recent Executive Order issued by Governor Newsom (N-62-20) on Workers Compensation policy, the CA Department of Insurance has issued a decision regarding CDI File no. REG-2020-00007. This file addresses critical Workers’ Compensation insurance COVID-19 related issues that will affect the construction industry for years to come.

Amendments include General Classification Procedures, and, Exposure Information reporting from insurers, enabling the tracking of COVID-19 related Data.

Included also is the specification that all claims directly arising from a diagnosis of Coronavirus disease 2019 (COVID-19) shall not be reflected in the computation of an experience modification. Gladly, this amendment was included as it was of most concern to our membership and to the construction industry as a whole. 

It is critical to note the importance of correct claims adjustment coding. Consultation with your insurance provider and proper documentation of cases must be a priority.
